General Terms and Conditions

Bratislavská integrovaná doprava, a.s., with its registered office at Jankolova 6, 851 04 Bratislava, Slovak Republic, Company ID No.: 35949473, registered in the Commercial Register maintained by the Bratislava III Municipal Court, Section Sro, File Reg. No. 4799/B, hereby issues these General Terms and Conditions governing the use of the mobile application “IDS BK” (hereinafter referred to as the “General Terms and Conditions”).

These General Terms and Conditions shall apply mutatis mutandis to the use of the IDS BK mobile application module integrated within the ČSOB SmartBanking application, operated by Československá obchodná banka, a.s., with its registered office at Žižkova 11, 811 02 Bratislava, Company ID No.: 36 854 140, registered in the Commercial Register maintained by the Bratislava III Municipal Court, Section Sa, File Reg. No. 4314/B (hereinafter referred to as “Československá obchodná banka”).

Article I Introductory Provisions and Interpretation of Terms

1. The mobile application “IDS BK” (hereinafter referred to as “MA IDS BK”) refers to a software application that enables users to purchase tickets, search for public transport routes within the Integrated Transport System in the Bratislava Region (hereinafter referred to as “IDS BK”), and engage in dynamic, real-time communication with the user (customer) via a mobile communication device (hereinafter referred to as a “Smartphone”) operating on either the iOS or Android platforms. MA IDS BK is available for download via the App Store and Google Play.

2. The MA IDS BK module (hereinafter referred to as the “IDS BK Module”) integrated within the ČSOB SmartBanking application is a feature that allows users to purchase IDS BK tickets directly through the ČSOB SmartBanking app. Any user of the ČSOB SmartBanking application installed on a smartphone with an iOS or Android operating system shall automatically have access to the IDS BK Module.

3. The User refers to a natural person who uses the MA IDS BK application or the IDS BK Module to access the services and features it provides (hereinafter referred to as the “User”). The User is not permitted to contribute content or engage in any other activity within MA IDS BK or the IDS BK Module beyond standard use of the services offered.

4. The owner and operator of MA IDS BK is Bratislavská integrovaná doprava, a.s. (hereinafter referred to as the “Operator”).

5. The creator of the MA IDS BK application and its underlying software, and the sole holder of the intellectual and economic rights to the application and its underlying software within the meaning of Section 13 of Act No. 185/2015 Coll., the Copyright Act, as amended (hereinafter referred to as the “Copyright Act”), is Casperise s.r.o., with its registered office at Sásovská cesta 16/A, Banská Bystrica, Company ID No.: 46973516, registered in the Commercial Register maintained by the District Court of Banská Bystrica, Section Sro, File Reg. No. 23554/S. Casperise s.r.o. is the exclusive party entitled to exercise the creator’s economic rights in accordance with the applicable provisions of the Copyright Act.

6. The owner and operator of the IDS BK Module is Československá obchodná banka, a.s., which consents to the fair and proper enforcement of these General Terms and Conditions in respect of the use of the IDS BK Module.

7. The creator of the IDS BK Module and its underlying software, and the sole holder of the creator‘s intellectual and economic rights under Section 13 of Act No. 185/2015 Coll., the Copyright Act, as amended (hereinafter referred to as the “Copyright Act”), is Elmolis j.s.a., with its registered office at Sásovská cesta 14277/16A, 974 11 Banská Bystrica, Company ID No.: 51961300, registered in the Commercial Register maintained by the District Court of Banská Bystrica, Section Sja, File Reg. No. 7/S. Elmolis j.s.a. is the exclusive party entitled to exercise the creator’s economic rights in respect of the application and its underlying software in accordance with the relevant provisions of the Copyright Act.

Article II Terms of Use of MA IDS BK and the IDS BK Module

1. The User may access MA IDS BK on a Smartphone running iOS version 10.0 or later, or Android version 9.0 or later.

2. The IDS BK Module may be used by the User on a Smartphone running iOS version 13.0 or later, or Android version 6.0 or later. The User must have the ČSOB SmartBanking application installed on their device, as access to the IDS BK Module is provided through this app. Additionally, the IDS BK Module permits the User to register with MA IDS BK; registration is mandatory for use of the IDS BK Module.

3. The core functions of MA IDS BK are as follows:

  1. the purchase of tickets using digital accounts (hereinafter referred to as “Digital Accounts”),
  2. searching for public transport routes within the IDS BK network,
  3. receiving customer information via notifications (hereinafter referred to as “Notifications”),
  4. sending messages to the Operator of MA IDS BK.

4. The core function of the IDS BK Module is:

  1. the purchase of public transport tickets using Digital Accounts;

5. The terms governing the use of tickets purchased via MA IDS BK and the IDS BK Module are set out in the appendix to these General Terms and Conditions.

6. By installing and registering with MA IDS BK or the IDS BK Module, the User expressly and unconditionally agrees to these General Terms and Conditions.

7. The User acknowledges that MA IDS BK and the IDS BK Module are provided free of charge. Access to all parts of MA IDS BK and the IDS BK Module is granted exclusively to Users who have completed the registration process.

Article III License

1. The User is granted permission to download a copy of MA IDS BK onto their Smartphone for personal use only. This copy is intended solely for the User’s private, non-commercial purposes. Any breach of this provision shall entitle the Operator to immediately suspend the User’s access to MA IDS BK, to which the User expressly and unconditionally consents. This shall be without prejudice to the Operator’s right to seek compensation for any damages incurred.

2. The User is not permitted to analyse, alter, modify, supplement, reproduce, adapt, distribute, or translate MA IDS BK from machine code into source code, nor to modify or adapt the application to suit their own needs, either personally or through third parties. Furthermore, the User is not authorised to create a backup copy of MA IDS BK, whether personally or via third parties, as such a copy is not necessary for the proper functioning and use of the application. The User is also prohibited from examining or testing MA IDS BK in a manner intended to uncover the underlying principles or any components of the application. Any breach of the provisions set out in this point shall entitle the Operator to immediately suspend the User’s access to MA IDS BK, to which the User expressly and unconditionally consents. This shall be without prejudice to the Operator’s right to seek compensation for any damages incurred.

3. By registering with MA IDS BK, the User does not obtain any ownership, property, or personal rights in respect of MA IDS BK, its software, or any of its components, but solely acquires a right to use MA IDS BK in accordance with the terms set out in these General Terms and Conditions.

4. The provisions of this Article, save for point 1, shall apply mutatis mutandis to the IDS BK Module.

Article IV Privacy Policy

1. The protection and processing of personal data is governed by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (the General Data Protection Regulation, “GDPR”), and by Act No. 18/2018 Coll. on the protection of personal data and amendments to certain laws (hereinafter referred to as the “Act”). In accordance with these provisions, we hereby inform you, as the data subject, about the processing of your personal data in connection with your registration with MA IDS BK.

2. When registering as a User and purchasing tickets via MA IDS BK, the User is required to provide the following personal data:

  1. first name, surname, telephone number, and email address,
  2. where the User is under 16 years of age, personal data of their legal guardian, including academic title, first name, surname, date of birth, full address, telephone number, and email address.

3. To purchase prepaid tickets, which are non-transferable and issued solely in the name of the User in accordance with the IDS BK Transport Regulations, extended registration with MA IDS BK is required. For extended registration, the User must also provide the following::

  1. date of birth,
  2. permanent address,
  3. a facial image (electronic photograph),
  4. a copy of an identity document,
  5. copies of documents proving entitlement to a discount.

4. When registering as a User and purchasing tickets via the IDS BK Module, the User is required to provide the following personal data:

  1. an e-mail address, which will be automatically provided via the SmartBanking application;
  2. if the User is under 16 years of age, the personal data of their legal guardian, including: academic title, first name, surname, date of birth, full address, telephone number, and e-mail address.

5. To purchase travel passes through the IDS BK Module, extended registration is required. These passes are non-transferable and issued exclusively in the name of the holder, in accordance with the IDS BK Transport Regulations. As part of the extended registration, the User must provide the following:

  1. date of birth,
  2. permanent address,
  3. a facial image (electronic photograph)
  4. copies of documents proving eligibility for a discount.

6. Each extended registration profile is valid for a period of three years. Once expired, the registration must be renewed.

7. The documents listed in points 3 and 5 are used solely to verify the submitted information and to ensure that travel discounts are correctly applied and duplicate travel passes can be issued when necessary. Upon approval, all submitted documents will be permanently deleted. In the event of rejection, all submitted data will be permanently deleted, and the User may submit a new application. Eligibility for a travel discount will also be verified through the portal of the Ministry of Education, Science, Research and Sport of the Slovak Republic at: https://www.potvrdeniaonavsteveskoly.sk/.

8. If the User is under 16 years of age, the processing of their personal data is lawful only if consent has been given or approved by their legal guardian. The User is required to provide complete and accurate personal data.

9. By registering, the User confirms their agreement to the General Terms and Conditions for the use of MA IDS BK, and consents to the processing, handling, and storage of the personal data provided in connection with registration and use of MA IDS BK.

10. The Operator will not disclose or share the User’s personal data with third parties, except where required by applicable legal regulations or in specific cases with the explicit consent of the data subject.

11. The Operator has implemented appropriate technical and organizational measures aligned with the nature and purpose of personal data processing. These measures take into account the available technological resources, the sensitivity and importance of the personal data involved, and the potential risks that could affect the security or operation of the information system.

12. The User has the right to obtain confirmation from the Operator as to whether their personal data is being processed. If such data is being processed, the User has the right to access it, along with the following information:

  1. the purpose of the processing of personal data,
  2. the categories of personal data being processed,
  3. the recipients or categories of recipients to whom the personal data has been or will be disclosed, particularly if they are located in third countries or international organizations, where possible,
  4. the period for which the personal data will be stored; if that is not possible, the criteria used to determine that period,
  5. the right to request from the Operator the rectification or erasure of personal data concerning the User, the restriction of its processing, or to object to such processing,
  6. the right to lodge a complaint with a supervisory authority,
  7. the source of the personal data, if it was not obtained directly from the User,
  8. the existence of automated decision-making, including profiling; in such cases, the Operator shall provide meaningful information about the logic involved, as well as the significance and potential consequences of such processing for the User.

13. If the User believes that any personal data processed by the Operator is incorrect or incomplete, they may request that the Operator provide access to this data, correct it, or delete it. Requests for access to personal data may be submitted in one of the following ways:

  2. by post to the registered office of Bratislavská integrovaná doprava, a.s.:Jankolova 6, 851 04 Bratislava, Slovak Republic

14. In order for the Operator to process a request for access to personal data, the User must:

  1. provide sufficient information to verify their identity (to confirm that the person making the request is indeed the User or their legal guardian).

15. The Operator declares that if it processes the User’s personal data based on their consent (e.g. for marketing purposes), and the User submits a written request to withdraw that consent before the agreed period expires, the Operator will delete the User’s personal data without undue delay, and no later than 30 days from the receipt of the withdrawal.

16. If the User wishes to file a complaint regarding the way their personal data is processed, they may contact the Operator’s designated Data Protection Officer (DPO) at dpo@bid.sk, or by mail at the registered office of Bratislavská integrovaná doprava, a.s.: Jankolova 6, 851 04 Bratislava, Slovak Republic. The DPO will investigate the complaint and work with the User to reach a resolution. If the User remains dissatisfied and believes their personal data has not been handled in accordance with Act No. 18/2018 Coll. on the Protection of Personal Data and on Amendments to Certain Acts, they may contact the Office for Personal Data Protection.

17. The provisions of this Article of the General Terms and Conditions shall apply mutatis mutandis to the processing of personal data provided by Users to the Operator through the IDS BK Module.

Article V Common and Final Provisions

1. The Operator publishes the General Terms and Conditions on its website at www.bid.sk/mobilna-aplikacia/, within the MA IDS BK application, and in the IDS BK Module. The Operator reserves the right to update, modify, or supplement the General Terms and Conditions at any time, without requiring the prior or subsequent consent of the User. The Operator shall notify the User of any update, modification, or supplement to the General Terms and Conditions no later than seven (7) calendar days before the changes take effect. Notification shall be made by displaying a message in the MA IDS BK application or the IDS BK Module, or by sending an email to the address provided by the User during registration with MA IDS BK. In either case, the Operator’s notification obligation shall be deemed fulfilled.

2. The Operator reserves the right to terminate or restrict the operation of MA IDS BK or the IDS BK Module at any time, without providing a reason and at its sole discretion. The User shall be informed of such action without undue delay via MA IDS BK, the IDS BK Module, or by email sent to the address provided during registration. The Operator may also cancel a User’s registration in MA IDS BK at any time, without providing a reason.

3. Any contractual relationships between the Operator and Users of MA IDS BK or the IDS BK Module that are not expressly governed by these General Terms and Conditions shall be subject to the laws of the Slovak Republic.

4. These General Terms and Conditions shall enter into force and take effect on 7 June 2025.


USING ELECTRONIC TICKETS PURCHASED THROUGH MA “IDS BK” (ELECTRONIC TICKET USE GUIDELINES)

Article I Introductory Provisions

1. These Guidelines set out the conditions for purchasing and using IDS BK single-journey electronic tickets (referred to as “eCL1C”) and prepaid travel passes (“PCL”) purchased through the MA IDS BK mobile application. Any matters not expressly governed by these Guidelines shall be subject to the provisions of the IDS BK Transport Regulations (“PP IDS BK”), which apply accordingly.

2. eCL1C and PCL (collectively referred to as “eCL”) may also be purchased via the IDS BK Module. Unless otherwise stated in this document, the same terms and conditions for the purchase and use of eCL tickets apply as when purchasing directly through MA IDS BK.

3. The type, zone coverage, and validity period of electronic tickets, as well as the conditions for their use, are defined by the IDS BK Transport Regulations (PP IDS BK).

4. Electronic tickets (eCL) are sold by Bratislavská integrovaná doprava, a.s.

5. Unless otherwise indicated by the context of these Guidelines, capitalized terms that are defined in the General Terms and Conditions but not specifically defined herein shall carry the same meaning as in the General Terms and Conditions.

Article II Creating a Digital Account and Payment Terms

1. A Digital Account is automatically created when the User registers in the MA IDS BK app.

2. Users can top up their Digital Account with credit using any of the available payment methods in MA IDS BK.

3. The minimum top-up amount is €5, while the maximum balance allowed on a personal Digital Account is €150.

4. If the Digital Account is closed, any remaining credit will be refunded to the User in the agreed manner. If no refund method has been agreed upon, the account will be deactivated and the Operator will proceed according to Article VI of the Guidelines and the applicable Price List.

Article III Purchasing eCL

1. eCL1C tickets can only be purchased after registering with MA IDS BK or by creating a new account through the IDS BK Module. This option is not available to unregistered users. PCL tickets can only be purchased after completing extended registration.

2. An internet connection is required to purchase eCL tickets. All data costs related to the internet connection are the responsibility of the User.

3. Users can purchase eCL1C tickets in one of two ways:

  1. By selecting from the eCL ticket offer – These tickets are not issued for specific zones. However, the User must select a departure stop when purchasing the ticket,
  2. Based on a searched route – These tickets are valid only in the zones included in the selected route for which the User has confirmed the "Buy ticket" option.

4. After selecting an eCL1C ticket according to points 3.a) or 3.b) of these Guidelines, the User may specify the number of accompanying co-passengers. An accompanying co-passenger is a person or piece of luggage traveling on the same route as the User. Tickets for accompanying co-passengers will have the same zone and time validity as the User’s eCL1C ticket; supplementary tickets (e.g. for transporting luggage, dogs or bicycles/ scooters) will be issued with the validity selected for such ticket. eCL1C tickets for accompanying co-passengers are available in three fare categories: standard, discounted, and supplementary. When purchasing through MA IDS BK, a maximum of 30 eCL1C tickets may be bought per fare category. When purchasing through the IDS BK Module, the maximum is 10 tickets per fare category.

5. PCL tickets can only be purchased by users with extended registration. The purchase is made by selecting from the available ticket options.

6. Users can also buy eCL1C tickets together with PCL tickets (for example, for travel outside the PCL validity period or for accompanying co-passengers).

7. By choosing the payment method, the User confirms the purchase of the selected quantity and types of eCL1C or PCL tickets. Please note that purchased eCL1C tickets are non-refundable.

8. The validity of an eCL1C ticket begins immediately upon purchase. However, through MA IDS BK, you have the option to set a later start time manually. When purchasing a ticket via the routes search in MA IDS BK, the ticket’s validity will commence at the scheduled arrival time of the bus or tram service at the selected stop (as per the timetable). Please note that with the IDS BK Module, it is not possible to delay the start time—tickets become valid immediately upon purchase.

9. Passengers may only board the vehicle if they hold a valid ticket, which must be valid no later than the scheduled departure time from the stop. Users must hold a valid eCL for the entire duration of their journey.

10. An eCL1C ticket with a delayed start time (postponed validity) can be cancelled up to 5 minutes before activation if needed. The refunded amount will be automatically credited to the user’s account. If less than 5 minutes remain until activation, the ticket can only be activated, not cancelled.

11. A list of valid eCL1C and PCL tickets, tickets not yet valid, and tickets whose validity has recently expired, is displayed on the MA IDS BK homepage or the IDS BK Module homepage. The tax document for purchased tickets will be sent to the user’s registered email address provided during MA IDS BK registration, or the email linked to registration via the IDS BK Module (automatically taken from the SmartBanking app), or can be accessed directly within MA IDS BK under Profile – Purchase History.

Article IV Validity of eCLs and Their Inspection

1. A valid eCL1C ticket must include:

  1. a validity period displayed as a dynamic countdown,
  2. the fare type (standard/ discounted/ luggage),
  3. the number of passengers,
  4. time and zone validity,
  5. boarding stop and zone,
  6. a list of zones where the ticket is valid, if purchased for specific zones,
  7. an alphanumeric ticket identification code,
  8. a QR code.

2. A valid PCL ticket must include:

  1. a validity period displayed as a dynamic countdown,
  2. the fare type (standard/ discounted),
  3. time validity,
  4. a list of zones where the ticket is valid,
  5. an alphanumeric ticket identification code,
  6. a QR code,
  7. a portrait photo of the User, along with their first name and surname.

3. The User must allow an authorized carrier representative to properly verify the validity of the eCL by presenting a Smartphone with the active display showing the eCL during the inspection. Upon request, the User must also prove that the MA IDS BK app or the IDS BK Module is fully functional and operational, that the eCL displayed is genuinely from the app or module, and not merely a copy of another ticket. Users or passengers holding a discounted eCL must also present a document proving their entitlement to the discount, in accordance with the valid PP IDS BK.

4. Upon request, the User must present an identity document or another carrier-issued document containing a photo, first name, and surname matching the MA IDS BK User.

5. The eCL is considered invalid, and the User (and any accompanying co-passenger) is regarded as traveling without a valid ticket if:

  1. the eCL is not valid at the time of inspection, meaning its validity period has not yet started or has already expired, or the purchased zones do not correspond to the route taken,
  2. the eCL was not purchased through the MA IDS BK app or the IDS BK Module with which the User identifies themselves,
  3. the eCL has been altered, rewritten, or forwarded in any way,
  4. the eCL cannot be verified due to issues on the User’s side (e.g., broken, malfunctioning, or dead Smartphone),
  5. the User purchased the eCL at the time when the ticket inspection was taking place,
  6. the User failed to comply with the conditions set out in the PP IDS BK and/or these General Terms and Conditions,
  7. the eCL cannot be verified during the inspection based on its assigned code.

6. The authorized public transport company representative is not permitted to confiscate the smartphone containing the eCL.

Article V Complaints

1. If the User followed the instructions set out in the General Terms and Conditions when purchasing an eCL but still experiences issues such as incorrect charges, unauthorized deductions without ticket delivery, or other problems, they have the right to submit a complaint.

2. Complaints must be submitted in writing, by one of the following methods:

  1. electronically, by email to info@idsbk.sk,
  2. by post to the registered office of Bratislavská integrovaná doprava a.s., Jankolova 6, 851 04 Bratislava, or
  3. in person at the registered office of Bratislavská integrovaná doprava a.s., Jankolova 6, 851 04 Bratislava, to an authorized employee of the Tariff and Sales Department who is present.

3. The complaint must clearly state the User’s requests, be briefly justified, and include any documents supporting the claim.

4. Bratislavská integrovaná doprava, a.s. is required to decide on how to handle the complaint without undue delay. In straightforward cases, this will be done within 3 working days of receiving the complaint. In more complex cases—especially when a detailed technical assessment of the service is needed—a decision will be made no later than 30 days from the date the complaint was filed.

5. After deciding how to handle the complaint, Bratislavská integrovaná doprava, a.s. will proceed without delay. In justified cases, the handling may take place later, but in any event, it will not exceed 30 days from the date the complaint was filed. If the complaint is not resolved within this timeframe, the customer has the right to withdraw from the contract.

6. Bratislavská integrovaná doprava, a.s. may resolve the complaint by refunding the ticket purchase price, offering a reasonable discount on the ticket price, or rejecting the complaint with a written explanation.

7. In the event of a PCL cancellation or a validated fare complaint, the refund will be made using the original payment method — either by crediting the electronic wallet or refunding the payment card used. In exceptional cases, and by mutual agreement with the customer, the refund may be made to a different bank account at no additional cost to the customer. The bank account must be held within SEPA member countries, and the customer is required to provide the account number in IBAN format.
